TERMS OF SALE
These Terms of Sale (“Terms”) apply to purchases of HMR nutritional/food products (the “HMR Products”) made directly by consumers (“you” or “Customer”) from HMR Program, Inc. (“HMR”) through our website. These Terms are subject to change at any time without prior notice. However, the version of these Terms in effect at the time you place your order will govern that purchase.
1. Product Use
HMR Products are intended for personal use only and may not be resold or redistributed. If you are participating in a medical or medically supervised weight-loss program, use of HMR Products should be in accordance with the guidance of your licensed healthcare provider.
2. Medical Disclaimer
HMR Products may be used as part of a low-calorie or very low-calorie diet. These diets may require medical supervision. HMR does not provide medical advice and is not a licensed healthcare provider. You are solely responsible for consulting your physician before using any HMR Products or beginning any diet program.
3. Payment Terms
All purchases must be paid using an accepted payment method and in accordance with the payment terms provided to you prior to finalizing your purchase. Prices are subject to change without notice prior to checkout. Sales tax may be charged where applicable based on your shipping address.
4. Availability & Shipping
Product availability may be limited. HMR is not liable for delays or failure to deliver caused by circumstances beyond our control. Title and risk of loss transfer to you when the HMR Products are handed to the carrier. Shipping times are estimates only and are not guaranteed.
Standard Shipping and Handling Charges in the Contiguous U.S.
We ship orders either UPS, USPS, or FedEx from our distribution center typically within one to two business days of the receipt of your order. Large order volumes may impact shipping timelines. You should receive your order within 2-7 business days after it has been placed.
While we make every attempt to get your HMR Products to you as fast as possible, we cannot guarantee delivery time. To ensure that you receive your order when you need it, please plan ahead.

Never run out of HMR Products with our automatic delivery program! Free shipping and 5% discount on orders over $100 are applied to all Healthy Solutions at Home Phase 1 and Phase 2 regularly scheduled orders. These programs are free to join and you can cancel at any time.
Free shipping applies only to orders shipped within the contiguous U.S. However, the Healthy Solutions at Home 5% discount on orders of $100.00 or more before shipping charges will still apply while the buyer is an active auto-delivery member outside of the contiguous U.S.
Holiday Shipping Schedule
Please note that the shipping and delivery of orders will be impacted by national holidays. Please plan accordingly. If you place an order, or have an HMR order scheduled to be processed in the week leading up to a holiday, you may want to make changes under My Account, and have it processed sooner and/or have it shipped to an alternative address. Please note that HMR offices are closed on national holidays, and orders will not be packed until the following business day.
Important Information on HMR Bar Orders and Shipping During the Summer Months
Many specialty chocolate manufacturers do not ship direct to consumers in the hotter months due to potential melting issues. However, we are committed to providing you with HMR Bars year-round.
NOTE: If you find that your bars are softer than you like due to the heat, allow the box to sit undisturbed overnight in a cool place. Temperature changes do not impact the nutrition (or flavor) in any way.
Required Signature
Deliveries to residential addresses typically do not require a signature. However, in certain instances, UPS may require a signature. If no one is available to accept the package, UPS will leave a note following each delivery attempt. UPS will make three delivery attempts before returning the package to HMR.
Email Confirmation and Contact Information
Once your order has been shipped, you will receive an email that will provide you with a tracking number. Use this tracking number to track your package via UPS, FedEx, or USPS.
5. Subscriptions
Some items in our store may be offered to you as a subscription. When you purchase a subscription you'll receive repeat deliveries. These are based on the subscription duration and frequency that you select.
Your payment details will be stored securely and you'll be charged for each of these deliveries, unless you choose to pay in advance.
Some subscriptions may auto-renew at the end of their duration. If you don't want to renew a subscription you can cancel it.
If you want to cancel or change your subscription, you can do it at any time. Your order confirmation emails have links to your order. You can manage your subscription from there.
6. Returns, Refunds & Defects
We stand behind all of our products, and if you are not satisfied, you have 30 days from the date your product is ordered to try it and request a refund if you don’t love it.*
To Request a Refund
Send us an email at customerservice@hmrprogram.com with the subject line REFUND REQUEST and include your order number, order date, the item(s) for which you would like to receive a refund, and the quantities for each, along with the email address that was used to place the original order.
Exceptions
No refunds will be issued for recurring subscription orders that were processed prior to customer cancellation. Customers are responsible for editing and managing their subscriptions or cancelling on the website prior to the processing date.
Refunds only apply to first-time purchases of a specific product(s).
Only products purchased through www.hmrprogram.com are eligible for a refund under this policy. If you have purchased through one of our retail partners, including Amazon, please reach out to them regarding your return request.
Shipping costs are non-refundable.
This policy does not affect any rights you may have under applicable consumer protection laws.
7. Changes & Discontinuation
HMR reserves the right to modify or discontinue any Product without notice. In the event of discontinuation after your order is accepted, HMR will issue a refund.
8. Intellectual Property
You may not use the HMR name, logo, trademarks, or branding for any commercial purpose without our prior written consent. You may not alter or remove any labels, branding, or packaging.
9. DISCLAIMER OF WARRANTIES
THE HMR PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS EXPRESSLY SET FORTH ABOVE, HMR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
This disclaimer does not limit any rights you may have under applicable consumer protection laws that cannot be waived.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, (i) HMR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF USE, ARISING FROM YOUR PURCHASE OR USE OF THE HMR PRODUCTS, EVEN IF HMR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND (ii) HMR’s total liability to you shall not exceed the amount paid by you for the specific Product giving rise to the claim.
11. Privacy
Your personal and payment information will be processed in accordance with HMR’s Privacy Policy. By placing an order, you consent to receive order-related communications.
12. Changes to Terms
HMR reserves the right to update, modify, or replace these Terms at any time in its sole discretion. The applicable Terms governing your purchase will be those in effect at the time your order is placed, as shown on the order confirmation or checkout page. We encourage you to review the Terms prior to each purchase.
13. Governing Law
These Terms shall be governed by and construed under the laws of the State of Delaware, without regard to its conflict of law principles.
*As of December 12, 2024, HMR is no longer accepting returns, due to food safety protocol.
